12-4-3: ELEMENTS OF AGREEMENT:
The development agreement shall be negotiated by the staff and city attorney and approved by the city council prior to signature by the parties. A brief statement shall be included describing the subdivision, its location, legal description, number of lots, and the date of subdivision approval by the city council. The agreement shall include, but not be limited to, the following:
   A.   Any conditions of approval from the review and approval process.
   B.   Time limit and provisions for extension or extinguishing the agreement.
   C.   Phasing plans, if any, and a description of any required temporary improvements and the terms of those improvements.
   D.   A description of construction improvements to be installed on site and off site.
   E.   Covenants, if any, made by the developer to the city.
   F.   Covenants, if any, made by the city.
   G.   Details of dedications beyond those required in chapter 6 of this title, design and improvement standards.
   H.   Construction improvement elements as detailed in section 12-4-10 of this chapter. (2003 Code § 12-05-03)
