§ 90.27 CONFISCATING OF POULTRY.
   (A)   When any poultry are found running at large for whom no owner can be found as required by § 90.26, or if the owner shall refuse to take up his or her poultry after being notified, then it shall be the duty of the Animal Control Officer to confiscate the poultry, and if no owner shall claim the same within three days after the confiscation the Animal Control Officer shall proceed to sell the same at public auction, after giving five days’ notice of the sale by three written or printed notices to be posted at three public places within the city limits.
      (1)   The notice shall state the number of poultry, kind to be sold, and the time and place of sale.
      (2)   After paying the expenses of taking up and keeping the poultry, and the costs of the sale, the balance, if any, is to be paid to the owner of the poultry, and if not claimed by the owner, is to be paid into the city treasury.
   (B)   Any poultry taken up by the Animal Control Officer may be returned to the owner at any time before their sale, by the owner paying all costs due to confiscation.
