§ 34.05 FIRE DEPARTMENT.
   (A)   Pursuant to I.C. 36-8-2-3, the Town Council may organize fire companies and regulate their government and provide all necessary apparatus for the extinguishment of fires.
   (B)   In order to preserve the character of the Volunteer Fire Department and in order to protect the substantial investment in building and equipment which is being placed in the custody and care of the Department, and provide for its proper use and maintenance by responsible individuals.
   (C)   In order to safeguard and protect the rights, life and property of the citizens of the Town of Beverly Shores, the following regulations are hereby adapted for the government of the Beverly Shores Volunteer Fire Department:
      (1)   The Beverly Shores Volunteer Fire Department Inc. shall comply with all the provisions of the Indiana state statutes regulating corporations including the submission of reports required by the Secretary of State. Proof of compliance shall be presented to the Town Council in January of each year;
      (2)   All regular meetings of the Department shall be held in accordance with Robert’s Rules of Order;
      (3)   No meetings of the Board of Directors and officers shall be held unless each shall have been given at least 5-days’ notice in writing, and no action shall be taken unless a quorum of the officers and directors be present;
      (4)   Written minutes be taken and preserved of all meetings and actions taken by the Fire Department and a permanent record kept thereof. Records shall be open to the public at any time as provided by law;
      (5)   At least once each year the Department shall provide the Town Council with a certified, complete, itemized financial statement disclosing all income and disbursements. The report to be signed and approved by a majority of the officers and directors of the Fire Department;
      (6)   The officers and directors of the Fire Department shall be responsible for enforcing these provisions; and
      (7)   Any requests for necessary apparatus and equipment made to the Town Council shall be made in writing and accompanied by a certified copy of a resolution indicating that the resolution was passed by a majority of the officers and directors of the Fire Department and that proper and sufficient notice of the meeting was given to the officers and directors.
   (D)   Fee for excess false fire and carbon monoxide alarm calls. A fee as set forth in § 10.99 shall be charged to the owner of the property on which an electronic fire and/or carbon monoxide alarm is installed for each automatically generated false alarm call in excess of three such false alarm calls within a moving 12-month period. Manually generated alarms shall not be counted toward this limit. The fee shall be collected by the Clerk-Treasurer and any owner who fails to timely pay the charge shall not be eligible for a parking permit until all such fees are paid.
