§ 154.05 LICENSE; ISSUANCE, FEE, CONDITIONS AND POSTING.
   (A)   Issuance of license. If an application for a parking lot license is made in accordance with the provisions of this chapter, it shall be examined by the Town Council of Beverly Shores; if issuance of a license is approved by a 3/5 vote of the duly elected members of the Town Council, then the Clerk-Treasurer shall be instructed to issue a license to the applicant on payment of the proper license fee.
   (B)   License fee.
      (1)   For license fee, see the Town Fee Schedule, § 10.99.
      (2)   The applicant shall obtain the required license before beginning business operations.
   (C)   Special conditions of license.
      (1)   In accepting a license under the provisions of this chapter, an operator agrees that he or she will notify the Town Council at 1 of its regular meetings, as to any material change in the facts set forth in the statements of application.
      (2)   The operator also agrees that the lot or any part thereof will not be used for any other commercial enterprise of any kind.
      (3)   No motor vehicles shall be permitted to be parked in front of the parking lot on the street side or on the road; nor shall any motor vehicle be permitted on the inside of the parking lot in the area directly adjoining the entrance or exit thereof for a distance of 25 feet on each side of the entrance or exit.
   (D)   Posting of license. The license issued under the provisions of this chapter for operation of the parking lot shall be displayed in a prominent, clearly visible location within the parking lot.
