10-5-101: MINING PROHIBITED:
No person shall open or operate any mine in the city, nor shall any person remove any minerals from any property in the city, nor shall any person enter the subsurface of the city from any point inside or outside the city for the purpose of removing any minerals from any property in the city; except that a person who complies with the requirements of article 2 of this chapter may remove water from property within the city, and a person who complies with the requirements of article 3 of this chapter may remove oil, gas, and other hydrocarbon substances from property within the city.
For the purposes of this chapter, "mine" includes all mineral bearing properties of whatever bind or character, whether underground, quarry, pit, well, spring, or other source from which any mineral substance is or may be obtained. "Mineral", for the purposes of this chapter, includes all mineral products, both metallic and nonmetallic, solid, liquid, or gaseous, and mineral waters of whatever kind or character.
