The C-H (O) overlay zone may be applied only to property that meets all of the following criteria:
A. The underlying zone on the property is R-4X2.
B. The property is contiguous to property zoned C-3, which contiguous property shall be developed as an existing hotel on April 15, 2007, and that is operating in conformance with the city's zoning code. For purposes of this provision, "contiguous" does not include properties that are separated by an alley, street, or other public right of way.
C. The property is adjacent to an alley along a side property line that is not between the property and the contiguous hotel, or the rear property line, or both the rear property line and a side property line as described in this subsection. (Ord. 07-O-2511, eff. 4-13-2007)
