9-3-1: RUBBISH STORAGE AND HANDLING FACILITIES:
   A.   General: Except as provided in subsection B of this section, every building erected or constructed in the city shall have provided therein, or immediately adjacent thereto, space for the processing and storage of rubbish which space shall be maintained for that exclusive use. For commercial uses, rubbish shall be stored in a rubbish room or in a completely enclosed container, as part of power operated rubbish processing equipment. For residential uses, rubbish storage, within or under a building, shall be within a rubbish room. Rubbish storage space, rubbish rooms, and rubbish processing equipment shall be of sufficient size to facilitate the adequate handling of rubbish accumulations generated by the occupancy.
   B.   Storage Space Requirements: No rubbish storage space or rubbish room shall be required for a single-family residence located on a property that abuts an alley unless such property which abuts an alley does not receive trash pick up from the alley and the public works director determines that a rubbish storage space or rubbish room is needed.
   C.   Existing Buildings: Any building lawfully existing prior to March 1, 1981, which is nonconforming to the requirements of this section, shall be made to conform to the requirements of this section when additional floor area is added thereto or a new use is established therein.
   D.   Rubbish Quantities Generated: Occupancies or uses shall be assumed to generate, but not necessarily be limited to, the generation of rubbish in the following quantities:

      3.   Unspecified Uses: Rubbish quantities generated by unspecified uses, not fitting into the categories set forth in subsections D1 and D2 of this section, shall be determined by the director of building and safety and the director of public works.
   E.   Rubbish Storage Spaces; Number required:
      1.   Commercial uses:
         a.   One space; and
         b.   Additional spaces shall be required when the rubbish generated, as set forth in subsection D1 of this section, exceeds the capacity of the containers used and the frequency of collection. The number of spaces shall be subject to approval by the director of building and safety.
      2.   Multiple-family residential uses:
         a.   One space for the first ten (10) units; and
         b.   One space for each additional ten (10) units, or major fraction thereof.
      3.   Single-family residential uses:
         a.   One space; and
         b.   Additional spaces shall be required when rubbish generated as set forth in subsection D2 of this section exceeds forty (40) cubic feet. Additional space shall be added at the rate of six (6) square feet for each four (4) cubic feet, or major fraction thereof.
   F.   Rubbish Space Size And Dimensions:
      1.   Commercial and multiple-family residential uses:
         a.   Where no rubbish processing, such as compacting, shredding, or baling, is anticipated, each space shall contain not less than forty (40) square feet of floor area. The minimum inside dimensions shall be eight feet by five feet (8' x 5').
         b.   Where more than one rubbish space is required, such spaces shall be arranged so that all rubbish containers are accessible for the deposit of rubbish and are accessible for the removal of the containers without moving any other container.
         c.   Where compactors or other rubbish processing equipment is used, the space requirements shall be such as to provide a minimum of three feet (3') of clear space on all sides and shall be based on the quantity generated, as set forth in subsection D of this section. Compaction shall assume a volume reduction ratio of three to one (3:1).
         d.   All rubbish spaces shall have a clear minimum height of seven feet (7'). Where rubbish processing equipment is used, the space dimensions shall be sufficient so as to not inhibit the service or removal of the equipment or rubbish containers.
      2.   Single-family residential uses: Each space shall contain not less than forty (40) square feet of floor area with a minimum clear horizontal dimension of two and one-half feet (21/2') and a clear height dimension of not less than seven feet (7').
   G.   Rubbish Storage Standards:
      1.   Rubbish Processing Equipment: Where rubbish processing equipment, such as a compactor, shredder, or baling machine, is used, the size of the equipment shall be commensurate with the amount of rubbish generated and the frequency of collection. Containers receiving rubbish from a compactor shall be enclosed and leakproof. Any area within or under a building which contains rubbish processing equipment shall be equipped with an automatic fire sprinkler system. Where rubbish processing equipment is used, such equipment shall not generate sound audible to adjacent properties in excess of the levels set forth in title 5, chapter 1 of this code.
      2.   Rubbish Rooms: Walls and floors shall be constructed of durable materials, such as concrete tile, or masonry, approved by the director of building and safety. Floors, walls and ceilings shall be of two (2) hour fire resistive rating. Doors shall be of sufficient width to accommodate standard width bins and shall have one and one-half (11/2) hour fire resistive rating. The rooms shall be equipped with an automatic fire sprinkler system adequate to cover all portions of the room.
      3.   Rubbish Chutes: Rubbish chutes shall be of masonry construction, shall have an automatic fire sprinkler located at the topmost point, and shall have not less than one hour fire protected openings.
      4.   Rubbish Storage Space Outside Of Buildings:
         a.   Multiple-family residential uses: Rubbish storage space not provided inside a building in the multiple-family residential zones shall be located in a rear yard. Such spaces shall be paved with a material, such as concrete, tile, or masonry, approved by the director of building and safety. Such spaces shall have the same area, dimensions and accessibility as set forth in subsection F1 of this section and shall be screened from view with a five foot (5') high masonry wall and solid gates, which gates shall be of sufficient width to accommodate standard width bins.
         b.   Single-family residential uses: Rubbish storage areas shall be paved with a material, such as concrete, tile or masonry, approved by the director of building and safety, such areas shall not be located in any yard abutting a street where a setback is required by title 10, chapter 3 of this code. Where rubbish storage areas are visible from a street, such areas shall be screened from view by a five foot (5') high opaque wall or fence.
   H.   Location And Access; Commercial And Multiple-Family Residential Uses:
      1.   Where an alley abuts a property, and a building is required to have rubbish storage facilities, such facilities shall be directly accessible to the alley. Access and distance shall be subject to approval by the director of building and safety and the public works director. Access areas shall be paved and sufficient in dimension to allow the easy removal of the largest container.
      2.   Where no alley is available, rubbish facilities shall be directly accessible from a street. The access shall be paved and subject to approval by the director of building and safety and the public works director.
      3.   Where rubbish storage floor surfaces are below or above surrounding grade, access shall be by ramps not to exceed a slope of one in twelve (12).
      4.   Where on site loading spaces are provided, rubbish storage facilities shall be directly accessible to such loading spaces. (Ord. 89-O-2083, eff. 12-21-1989; amd. Ord. 92-O-2141, eff. 6-5-1992)
