A. Maintenance Required: The owner of property abutting a public street or streets shall maintain all property outside the lot and property lines and inside the curb lines upon such public street or streets, except that the property owner shall not be required to remove diseased or dead wood.
B. Serving Order For Maintenance: If the director of public works finds that any such maintenance work is necessary, the director shall serve a written order on the owner of the abutting property specifying therein the work necessary to be done. The order may be served by either:
1. Making personal service of the order on the owner as permitted by Iowa rules of civil procedure (IRCP) 56. The person making the service shall make a return of personal service which shall state the time, manner and place of service, and the name of the person to whom a copy of the order was delivered; or
2. Mailing a copy of the order by certified mail to the property owner as shown by the records of the Scott County auditor.
C. Time Limit: The order required by this section shall set forth a reasonable time limit for compliance.
D. Right To Appeal: Any property owner to whom an order pursuant to this section is directed shall have the right, within forty eight (48) hours from service of the order, to appeal to the mayor who shall review the order within five (5) days and file his decision thereon. Unless the order is revoked or modified, it shall remain in full force and be obeyed by the property owner as directed, with the time for compliance to commence at the time of the mayor's decision.
