ADOPTING ORDINANCE

ORDINANCE 03-15

   AN ORDINANCE ADOPTING THE REVISED BETTENDORF CITY CODE

WHEREAS, the Bettendorf city code was originally published by Municipal Code Corporation in 1969, and it has been maintained and supplemented by Sterling Codifiers since 1996; and

WHEREAS, in August, 2013, the city council approved entering into a contract with Sterling Codifiers to re-organize the Bettendorf city code (res. 173-13); that process has been completed and the new code is ready for formal adoption; and

WHEREAS, pursuant Iowa Code section 380.8(2)(b), a public hearing has been held and a copy of the revised code has been made available for viewing in the office of the city clerk.

NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF BETTENDORF, IOWA:

SECTION ONE.

The entirety of the Bettendorf city code (1996 edition) is hereby repealed and amended by adopting the Bettendorf city code (2015 edition) in its entirety.

SECTION TWO.    Full Force And Effect

This ordinance shall be in full force and effect from the date of passage and publication as required by law.

SECTION THREE.    Repealer

This ordinance shall be construed to repeal any prior ordinance inconsistent herewith.

SECTION FOUR.    Severability Of Provisions

If any section, subsection, sentence, clause, phrase or portion of this ordinance be held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portion hereof.
