8-3A-13: SOLID WASTE AND RECYCLING CONTAINERS:
Every person owning, managing, operating, leasing or renting any premises, dwelling unit or any place where refuse accumulates shall provide, and at all times maintain in good order and repair, sufficient containers in number and size to hold such refuse accumulated therein between collection periods.
   A.   Container Specifications: Waste storage containers shall comply with the following specifications:
      1.   Residential waste containers:
         a.   Only solid waste and recycling containers provided by the city are allowed for curbside collection, with the specific size of the solid waste container chosen by the residential customer. If a resident requests an additional container(s), an additional monthly fee will be charged to the resident. These containers shall be leak-proof, waterproof and fitted with a fly tight lid and shall be properly covered at all times except when depositing waste therein or removing the contents thereof.
         b.   City-owned containers shall be assigned to particular residential premise and shall remain at that residential premise in the event the owner or occupant moves. Users of these containers shall not abuse or damage them and shall be liable for any loss or damage not caused by normal use. Worn containers shall be replaced by the city at no additional expense to the property owner.
         c.   In the event of refuse accumulation beyond the capacity of the container, the person producing or responsible for the refuse shall dispose of the same by placing the refuse in a plastic garbage bag, thirty two (32) gallon or smaller, with a city refuse collection sticker attached. These plastic garbage bags shall be sealed and of sufficient strength to hold the contents without rupturing or leaking when lifted.
      2.   Commercial waste containers:
         a.   Every person owning, managing, operating, leasing or renting any commercial premises where solid waste accumulates and where its storage in city-owned containers as required above is impractical, or in such cases that the city indicates residential-type service is not feasible, shall maintain metal bulk storage containers or dumpsters approved by the city.
   B.   Storage of containers.
      1.   Residential solid waste and recycling containers shall be stored in a building on the premises, or behind the front building line against the principal structure or accessory structure and screened from visibility to the greatest extent possible. The storage of containers shall not result in the creation of a public nuisance.
      2.   Commercial solid waste containers shall be placed in the location specified on the site plan approved by the city, and screened to limit visibility of the containers and to contain litter and debris. The storage site shall be well drained; fully accessible to collection equipment, public health personnel and fire inspection personnel.
   C.   Owner’s responsibility. All owners of residential and commercial premises shall be responsible for proper storage of all garbage and yard waste to prevent materials from being blown or scattered around neighboring yards and streets. All garbage shall be bagged before it is placed in solid waste containers in order to minimize blowing or loss of material when the containers are emptied.
   D.   Non-conforming Containers. Solid waste placed in containers that are not in compliance with the provisions of this section will not be collected. (Ord. 05-22, 4-5-2022)
