8-3A-2: DEFINITIONS:
For the purpose of this chapter, the following definitions shall have the meanings ascribed to them in this section unless different meanings are clearly indicated by the context:
ACCESS, DIRECT:
Direct, dedicated motor vehicle access from a public right-of-way to a dwelling unit.
ACCESS, INDIRECT:
Vehicular access, by motor vehicle or commercial vehicle, originating from a public right-of-way to a dwelling unit and shared with another dwelling unit. Indirect access may be considered, but is not limited to, the following: a private street, shared driveway, common parking lot, or other common means of vehicular access.
ASHES:
The residue of the combustion of solid fuels.
BUILDING DEBRIS:
Any refuse or residue resulting from minor noncommercial repairs to a private dwelling made by the owner or occupant thereof.
BUILDING WASTE:
Any and all refuse or residue resulting from building construction, reconstruction, repair or demolition; from grading, scrubbing or other incidental work in connection with any premises; or from replacement of building equipment or appliances.
BULK CONTAINER:
A metal container constructed so as to be watertight but with drain plugs at the lowest point of the container to facilitate the drainage of any liquids that might accumulate in the container or from cleaning the container. Bulk containers shall have doors that open on the top and close automatically during emptying. Bulk containers shall be designed so that they can be emptied mechanically by specially designed trucks. When not in use, side doors shall be closed at all times. These containers may also be referred to as “dumpsters” in this chapter.
BULKY WASTE:
Any large household items that cannot be properly enclosed within city-owned containers, and that meets the city’s criteria for bulk waste pickup, as may be revised from time to time. Bulk items include, but are not limited to, all furniture, electronics, mattresses, box springs, white goods, gas grills, wheelbarrows, bicycles, lawn equipment, carpet and carpet padding, individual items of construction and demolition waste, and all other fixtures and appliances.
CITY-OWNED CONTAINER:
Solid waste or recycling containers which the city purchases and provides to the owners or occupants of residential premises for the placement of solid waste or recycling collection by the city.
COLLECTOR:
Any person or firm authorized by the city to collect, transport and dispose of solid waste, yard waste or recyclable material from public and private places.
COMMERCIAL PREMISES:
Any business, industry, institution, church or non-profit organization.
COMMERCIAL WASTE:
Any solid waste generated from commercial premises as defined in this section above.
DEAD ANIMALS:
Animals that have died naturally or have been accidentally killed; animals or parts of animals from slaughterhouses are not included in this category.
DEPARTMENT:
The department of public works of the city.
DIRECTOR:
The director of public works of the city and authorized representatives.
DISCARD:
To place, cause to be placed, throw, deposit, or drop. (Iowa Code § 455B.361[1])
DISPOSABLE SOLID WASTE CONTAINER:
Disposable plastic or paper sacks with a capacity of twenty (20) to thirty five (35) gallons specifically designed for the storage of solid waste.
DWELLING UNIT:
Any room or group of rooms located within a structure and forming a single habitable unit with facilities which are used, or are intended to be used, for living, sleeping, cooking and eating.
GARBAGE:
All solid and semisolid, putrescible animal and vegetable waste resulting from the handling, preparing, cooking, storing, serving and consuming of food or of material intended for use as food, and all offal, excluding useful industrial by-products, and includes all such substances from all public and private establishments and from all residences. (IAC § 567-100.2)
HAZARDOUS WASTE:
Solid and liquid waste which requires special handling and disposal to protect and conserve the environment and human health including, but not limited to, pesticides, acids, caustics, pathological waste, radioactive materials, flammable or explosive materials, oils and solvents, and similar organic and inorganic chemicals and materials, containers and materials that have been contaminated with hazardous waste.
IDNR:
Iowa Department of Natural Resources.
LICENSED WASTE COLLECTOR:
Any person who has obtained a license as specified in this chapter from the city to collect or transport for consideration bulk refuse, household waste, institutional waste, commercial waste, industrial waste, building waste or building debris, regardless of the place of origin, over the streets of the city.
LITTER:
Any garbage, rubbish, trash, refuse, waste materials, or debris that is not properly and legally disposed. (Iowa Code § 455B.361[2])
MULTI-FAMILY PREMISES:
For the purpose of this chapter, multi-family premises shall mean any building under one roof which contains two (2) or more complete dwelling units. For avoidance of doubt, this definition is separate from definitions of multi-family premises or similar definitions set forth in other titles of the City Code, including Title 11 and Title 12.
OWNER:
In addition to the record titleholder, any person residing in, renting, leasing, occupying, operating or transacting business in any premises, and as between such parties the duties, responsibilities, liabilities and obligations hereinafter imposed shall be joint and several.
PRIVATE STREET:
A non-publicly owned street, road, or driveway. City-provided services may be conditionally provided on private streets.
PRIVATE WASTE COLLECTOR:
Any person who collects bulk refuse, household waste, building waste or building debris from premises owned or occupied by him within the city and transports said wastes over the streets of the city but shall not be deemed to include any governmental body or private party collecting by virtue of contract with a governmental body or agency.
RECYCLABLE MATERIAL:
Those materials which are capable of being recycled and which would otherwise be processed or disposed of as solid waste. Recyclable materials include, but not limited to, newspaper and accompanying inserts, magazines, corrugated cardboard, mixed and office paper, phonebooks, tissue, snack and cereal boxes, catalogs, shredded paper, mail, paperback books, all plastic bottles and containers (#1 through #7), steel cans, aluminum cans, glass containers, and any other materials the Waste Commission of Scott County determines to be recyclable.
RECYCLING:
The separation, collection, processing, recovering and sale or reuse of materials which would otherwise be disposed of as solid waste.
REFUSE:
Putrescible and non-putrescible wastes including but not limited to garbage, rubbish, ashes, incinerator ash, incinerator residues, street cleanings, market and industrial solid wastes and sewage treatment wastes in dry or semisolid form. (IAC § 567-100.2)
RESIDENTIAL PREMISE:
Single-family dwellings and multi-family dwellings that have direct access to a public street.
RUBBISH:
Non-putrescible solid waste consisting of combustible and noncombustible wastes, such as ashes, paper, cardboard, tin cans, yard clippings, wood, glass, bedding, crockery or litter of any kind. (IAC § 567-100.2)
SANITARY DISPOSAL:
A method of treating solid waste so that it does not produce a hazard to the public health or safety or create a nuisance. (IAC § 567-100.2)
SANITARY DISPOSAL PROJECT:
All facilities and appurtenances including all real and personal property connected with such facilities, which are acquired, purchased, constructed, reconstructed, equipped, improved, extended, maintained, or operated to facilitate the final disposition of solid waste without creating a significant hazard to the public health or safety, and which are approved by the IDNR director. (Iowa Code § 455B.301)
SINGLE STREAM RECYCLING:
The recycling process where all recyclable materials as designated by the city are placed co-mingled into a city-owned container(s) for collection.
SOLID WASTE:
garbage, refuse, rubbish, and other similar discarded solid or semisolid materials, including but not limited to such materials resulting from industrial, commercial, agricultural, and domestic activities. For purposes of this chapter, hazardous waste, toxic waste, or recyclable material is not included within the definition of solid waste.
WHITE GOODS:
All discarded household appliances including, but not limited to, refrigerators, freezers, air conditioners, dehumidifiers, clothes washers and dryers, conventional and microwave ovens, ranges and stoves, dishwashers, water heaters and softeners, furnaces, garbage disposals, trash compactors, heat pumps, humidifiers, air compressor and electric motors.
YARD WASTE:
Organic debris such as grass clippings, leaves, garden wastes, pruning’s, weeds, brush and tree branches produced as a part of the yard and garden development and maintenance. “Yard waste” does not include tree stumps or branches greater than six inches (6") in diameter.
YARD WASTE BAG:
2-ply, fifty (50) pound wet strength Kraft type paper bags which are degradable or biodegradable, with a maximum capacity of thirty (30) gallons, manufactured for the purpose of containing yard waste for regular collection and disposal and which display a printed statement designating that the bag is intended to hold yard waste.
