5-2-8: AUTHORITY OF CHIEF AT FIRE SCENE GENERALLY:
   A.   Authority:
      1.   The fire chief or his/her designee shall have command, control, and direction of all members of the fire department, ambulance personnel, and of all other persons, who may be present at fires, emergency medical calls, rescue situations, or hazardous materials incidents.
      2.   The fire chief or his/her designee shall implement the incident command system (ICS) on all responses upon arrival at the scene and shall be designated the incident commander. If an incident involves multiple agency response with multiple jurisdictional responsibilities, a unified command structure will be implemented. Representatives of all involved agencies should participate in the decision making process. The incident commander in a unified command structure will be the individual with jurisdictional responsibility, i.e., the police chief or his/her designee in a law enforcement related incident. The incident commander may call upon any person at the incident scene to assist firefighters in their duties, but no person who has not been trained as a firefighter shall be placed in a situation wherein such person's physical safety shall be endangered.    B.   Refusal To Assist Firefighters: No person shall neglect or refuse to assist the firefighters in their duties at any fire when called upon to do so by the fire chief or incident commander. (2008 Code § 11-39; amd. 2015 Code)
