The following are hereby declared public nuisances:
A. Nuisance Per Se: Any activity or condition which creates an unquestionable health or safety hazard.
B. Nuisance At Common Law: Any activity or condition which is listed or considered a nuisance under the common law of the state of Iowa.
C. Nuisance At Law: Any activity defined as a nuisance under Iowa Code chapter 657, as amended from time to time; and, any activity or condition defined in this chapter as a nuisance under the city's home rule.
D. Nuisance Within Public Way: Any item in the right of way for which a franchise or permit has not been received and which creates a hazardous condition for the public use of the right of way.
E. Other Nuisances: Any action or condition which, left unabated, may unreasonably endanger the health, safety, life, limb or property or cause damage or injury to residents of the city in the following particulars:
1. By reason of being a menace, threat or hazard to the general health of the community.
2. By reason of being a fire hazard.
3. By reason of being unsafe for occupancy.
4. By lack of sufficient maintenance of the structure, and/or being vacant either of which depreciates the enjoyment and use of the property immediately adjacent or in the immediate vicinity of the structure, to such extent that it is harmful to the community generally.
5. The following actions are declared public nuisances:
a. Illegal consumption of intoxicating liquors or illegal drugs.
b. Public urination or defecation.
c. Action which causes a reasonable person on his/her property to fear for personal safety or personal property of the person.
d. Acts of violence, including fighting among permittees on the property.
e. Discharge of a weapon, except as otherwise authorized by law or by a police officer in the line of duty.
f. Intentional obstruction of a residence.
g. Solicitation of acts of prostitution.
h. Solicitation of sale of illegal drugs. (2008 Code § 18-2)
