6-1-366: CONTROLLED ACCESS FACILITIES; UNLAWFUL USE; FACILITIES ESTABLISHED:
   A.   Defined: For the purpose of this section, a "controlled access facility" shall mean a highway or street especially designed for through traffic, and over, from or to which owners or occupants of abutting land or other persons have no right or easement or only a controlled right of easement of access, light, air or view by reason of the fact that their property abuts upon the controlled access facility or for any other reason. Such highways or streets may be freeways open to use by all customary forms of street and highway traffic or they may be parkways from which trucks, buses, and other commercial vehicles shall be excluded.
   B.   Unlawful Uses Enumerated: It shall be unlawful for any person to:
      1.   Drive a vehicle over, upon or across any curb, central dividing section or other separation or dividing line on a controlled access facility.
      2.   Make a left turn or a semicircular or U-turn at maintenance crossovers except by maintenance vehicles and authorized emergency vehicles.
      3.   Drive any vehicle except in the proper lane provided for that purpose and in the proper direction and to the right of the central dividing curb, separation section or line.
      4.   Drive any vehicle into the controlled access facility from a local service road except through an opening provided for that purpose in the dividing curb, dividing section or dividing line which separates the service road from the controlled access facility property.
      5.   Stop, park, or leave standing a vehicle, whether attended or unattended, upon the paved portion.
      6.   Stop, park or leave standing a vehicle, whether attended or unattended, upon the shoulders, or the right of way except at designated rest areas or in case of an emergency or other dire necessity.
      7.   No person shall have any right of ingress or egress across any controlled access facilities except at such points as are permitted by the Iowa department of transportation and the city.
      8.   Walk, ride a bicycle, ride an animal or animal drawn device upon I-74 or I-80 unless necessary to respond to an emergency (such as, but not limited to, vehicle breakdown) or pursuant to permission given by the Iowa department of transportation.
   C.   Facilities On U.S. 6 Established: There is hereby fixed and established controlled access facilities on primary road number U.S. 6 within the city, regulating access to and from said primary road from abutting property along said road as follows:
Kimberly Road (northbound) from Sta. 399+55.1 being approximately 1,532.8 feet northwesterly of 14th Street southeasterly to intersection with 14th Street and Mississippi Boulevard.
Kimberly Road (southbound) from Sta. 401+25 being approximately northwesterly of 13th Street southeasterly to intersection with 13th Street and Mississippi Boulevard.
13th Street from Mississippi Boulevard to State Street.
14th Street from Mississippi Boulevard to State Street.
   D.   Facilities On I-74 Established; Limitation Of Access Points: There is hereby fixed and established fully controlled access facilities on interstate road I-74 within the city, prohibiting access to and from said interstate road from abutting properties along the road, except at such designated points at which access may be permitted by the Iowa department of transportation, upon such terms and conditions as may be specified from time to time. Access rights shall not be destroyed except by purchase or appropriate condemnation proceedings thereof. Access rights shall be subject to such regulations in the interest of public welfare and safety as the city and the Iowa department of transportation may agree upon; provided, that no additional accessways or change of use shall be permitted by the city without the consent and approval of the Iowa department of transportation.
   E.   Facilities On U.S. 67 Established: There is hereby fixed and established controlled access facilities on primary road number U.S. 67 within the city regulating access to and from said primary road from abutting properties along said road as follows:
Grant Street from South Grant Street to 26th Street.
River Drive from the west city limits to 6th Street.
River Drive from 6th Street to 8th Street.
South Grant Street from Grant Street to 6th Street.
State Street from Fenno Road to the east city limits.
State Street from 8th Street to 26th Street.
State Street from 26th Street to the east city limits, being also the west city limits of the city of Riverdale.
   F.   Facilities On I-80 Established: There is hereby fixed and established fully controlled access facilities on interstate road I-80 within the city, prohibiting access to and from said interstate road from abutting properties along the road, except at such designated points at which access may be permitted by the Iowa department of transportation, upon such terms and conditions as may be specified from time to time. Access rights shall not be destroyed except by purchase or appropriate condemnation proceedings thereof. Access rights shall be subject to such regulations in the interest of public welfare and safety as the city and the Iowa department of transportation may agree upon; provided, that no additional accessways or change of use shall be permitted by the city without the consent and approval of the Iowa department of transportation.
   G.   Measurement, Points Of Reference Generally: The points of access shall consist of accessways from abutting property to the adjacent traffic lane or roadway and their locations shall be expressed in terms of "stations", each being represented a distance of one hundred feet (100'), measured along the centerline of the controlled access facility from the points of references stated in this section. Such measurements shall refer to the center of the accessways. (2008 Code § 17-366)
