A. Location: The location of this area is based on the Scott County Flood Insurance Rate Maps dated April 11, 2024 and June 9, 2014, as revised and provided by the Federal Emergency Management Agency. In addition to the Floodplain Area Standards, development within the floodway must meet the following applicable standards. The floodway is that portion of the floodplain which must be protected from developmental encroachment to allow the free flow of flood waters. The requirements of this section shall take precedence over any conflicting requirements of the city.
B. Special Floodway Provisions:
1. Where no floodway data has been provided, the Department of Natural Resources shall be contacted to provide a floodway delineation.
2. The applicant will be responsible for providing the Department of Natural Resources with sufficient technical information to make such determination.
3. No development shall be permitted in the floodway area that would result in any increase in the base flood elevation. Consideration of the effects of any development on the flood levels shall be based upon the assumption that an equal degree of development would be allowed for similarly-situated lands.
4. No development shall affect the capacity or conveyance of the channel or floodway of any tributary to the main stream, drainage ditch, or other drainage facility or system.
C. Uses Permitted: Uses are permitted and regulated in the floodplain area, except:
1. Any development considered to have flood damage potential such as, but not limited to, storage of materials and equipment, fill and a use which could obstruct flood flows is prohibited.
2. Encroachment by fill is prohibited.
3. The erection of a new structure, the expansion of an existing building, or the placement of a structure is prohibited.
D. Watercourse Alterations: Watercourse alterations or relocations (channel changes and modifications) must be designed to maintain the flood-carrying capacity within the altered or relocated portion. In addition, such alterations or relocations must be approved by the Department of Natural Resources.
E. Stream Crossings: Pipeline river or stream crossings shall be buried in the stream bed and banks or otherwise sufficiently protected to prevent rupture due to channel degradation and meandering or due to the action of flood flows.
F. Site Requirements: Conformance to all zoning regulations in regard to area, width, and yards is required. (2008 Code app. C art. V; amd. Ord. 02-14, 2-18-2014; Ord. 03-21, 2-16-2021; Ord. 07-24, 2-20-2024)
