12-2-3: PRELIMINARY APPROVAL; ACTION BY COMMISSION AND COUNCIL:
   A.   Time Limits For Action: Within thirty (30) days after the commission meeting next following submission to the city clerk of an application for approval of a plat of a subdivision, the commission shall review the application and shall study the preliminary plat to see if it conforms to the minimum standards and requirements outlined in this title, and shall approve or reject the plat within sixty (60) days after submission of the application to the commission.
   B.   Commission Recommendation; Council Authorization: If the commission does not act within sixty (60) days after the application for preliminary approval is submitted to the commission, the preliminary plat shall be deemed to be approved. Said sixty (60) day time period shall begin when all required preliminary plats, plans and documents have been received by the city. The subdivider may agree to an extension of time. The commission shall submit its recommendations to the council for its action in writing. The approval of the preliminary plat by the council does not constitute approval of the subdivision, but is merely an authorization to proceed with the preparation of the final plat.
   C.   Copies Of Approved Plat Distributed: One copy of the preliminary plat approved by the council and signed by the mayor and the clerk shall be retained in the clerk's office and one copy shall be retained in the office of the commission. One copy shall be authorization for the subdivider to proceed with the preparation of the final plat. (2008 Code § 28-21)
