§ 157.30 RESTORING STREET; DEPOSIT.
   (A)   It shall be the duty of any person desiring to make any cut or change, as provided in § 158.29, to secure from the City Engineer a statement specifying the estimated cost of restoring the street, alley, curb, gutter, sewer basin or sidewalk or other appurtenance thereto. The applicant shall deposit the amount of the estimated sum with the City Clerk who shall issue a duplicate receipt to the person for same.
   (B)   The duplicate receipt or copy thereof shall be delivered to the City Engineer by the applicant. The Engineer shall issue authority to the City Clerk to issue permit for the cutting, altering or change.
   (C)   (1)   The holder of the permit at the conclusion of the restoring of the street, alley, gutter,
curb, sidewalk, sewer or basin or appurtenance, shall notify the City Engineer who shall make an inspection of the same.
      (2)   If the work is satisfactory, the City Engineer shall give a statement to the person to that effect and the City Clerk shall, upon presentation of the statement, refund the deposit.
   (D)   If the work is not satisfactory, then the City Engineer shall notify the person to complete the same in a satisfactory manner within ten days from the receipt of the notice. If the work is still not satisfactorily completed, then the City Engineer or City Manager shall have the work done and pay for the same out of the deposit. The balance, if any, shall be refunded by the City Clerk.
   (E)   It shall be the duty of the City Clerk to keep the deposits in a separate account.
