§ 157.29 CUTTING PAVEMENT; PERMIT REQUIRED; FEES.
   (A)   It shall be unlawful for any person to cut, alter, mutilate, remove or change in any way or manner for any purpose any paved or traveled portion of any street or alley, curb, gutter, catch basin, storm sewer or any other appurtenance of the same or any sidewalk in the city without securing a permit from the City Clerk, after express approval by the City Engineer, to make the cut, alteration or change.
   (B)   The approval of the Engineer may be granted only in the following circumstances:
      (1)   When there is no other method of making a crossing with utilities;
      (2)   Where access to utilities cannot be obtained by boring under the street; or
      (3)   On streets, other than major thoroughfares or collector streets, which are not improved according to city standards as provided in Chapter 154 of this code of ordinances and are on file in the Engineer's office.
   (C)   Before a permit is issued, the applicant shall pay a fee in an amount determined by resolution of the City Council for each cut to be made.
   (D)   (1)   Street repairs after cutting made pursuant to this section shall be done according to approved standard details on file in the City Engineer's office;
      (2)   All street repairs must be completed within 96 hours of permit issuance;
      (3)   Additional time for repairs may be granted by the City Manager or his designee where extenuating circumstances have delayed the repairs. The request for additional time must be made in writing to the City Manager;
      (4)   If the repair (including street reopening) is not completed within 96 hours the city will make the repairs and charge the cost against the cash deposit of the permit holder.
   (E)   This requirement shall not apply to any person acting under the direct supervision of the City Engineer or City Manager, nor shall it apply to any person repairing or replacing a sidewalk under a sidewalk permit where the person only changes the sidewalk.
