(A) Generally. See § 422.99 for general Traffic Code penalty if no specific penalty is provided.
(B) Obstructions at railroad grade crossings.
(1) Any rail carrier violating § 440.04(A) shall be fined as follows:
(a) If the duration of the obstruction exceeds ten minutes, but is no longer than 15 minutes, the fine shall be not less than $200 nor more than $500;
(b) If the duration of the obstruction exceeds 15 minutes, but is no longer than 20 minutes, the fine shall be $500;
(c) If the duration of the obstruction exceeds 20 minutes, but is no longer than 25 minutes, the fine shall be $700;
(d) If the duration of the obstruction exceeds 25 minutes, but is no longer than 30 minutes, the fine shall be $900;
(e) If the duration of the obstruction exceeds 30 minutes, but is no longer than 35 minutes, the fine shall be $1,000; and
(f) If the duration of the obstruction exceeds 35 minutes, the fine shall be $1,000 plus an additional $500 for each five minutes of obstruction in excess of 35 minutes of obstruction.
(2) Any railroad employee violating § 440.04(B) shall be fined not less than $100 and not more than $500, plus costs of prosecution, for each offense.
(3) A separate offense shall be deemed committed each day during or on which a violation of any of the provisions of § 440.04 occurs or continues.
