§ 440.04 OBSTRUCTIONS AT RAILROAD GRADE CROSSINGS.
   (A)   No railroad corporation shall permit any train, railroad car or engine to obstruct public travel at a railroad–street or railroad–highway grade crossing for more than ten minutes, except where a train, railroad car or engine cannot be moved by reason of circumstances over which the railroad corporation has no control.
   (B)   No railroad employee shall willfully or intentionally permit any train, railroad car or engine to obstruct public travel at a railroad–street or railroad–highway grade crossing for more than ten minutes, except where the train, railroad car or engine cannot be moved by reason of circumstances over which the railroad employee has no control. However, no employee acting under the rules or orders of the railroad corporation or its supervisory personnel may be prosecuted for violations.
