§ 91.24 NOTICE TO THE OWNER; ABATEMENT PROCEDURES.
   Upon receipt of a investigation report finding a violation of § 91.20 of this chapter, the town’s Clerk-Treasurer shall complete the following.
   (A)   The town’s Clerk-Treasurer shall mail notice to the owner by certified mail, return receipt requested. The town’s Clerk-Treasurer shall obtain a receipt of mailing from the postal service which indicates the date of mailing and the name and address of the mailee. The notice shall contain the following information;
      (1)   A direction that the owner must clean the property of trash or mow or remove all weeds within ten days of the date of the notice;
      (2)   Notifies the owner that he/she has the right to appeal the abatement order by filing with the town’s Clerk-Treasurer a written notice of appeal within ten days of the notice. Upon receipt of a timely notice of appeal, the town’s Clerk-Treasurer shall place such appeal for hearing on the agenda for the next regular meeting of the Town Trustees;
      (3)   Notifies the owner that if he or she fails to clean the property of trash or mow or remove all weeds within ten days of the date of the notice, the town or its agent will clean the trash and mow or remove all weeds at the expense of the owner; and
      (4)   Notifies the owner that each day the property remains in violation of § 91.20 of this chapter shall be punishable by a fine of $50 per day.
   (B)   If the town’s Clerk-Treasurer has not received a signed receipt evidencing that the owner received the notice within ten days of the mailing, the town’s Clerk-Treasurer shall cause the notice to be posted on the subject property.
   (C)   Ten days after the owner signed for the certified mail notice or ten days after posting of notice on the property, whichever happens last, agents of the town are granted the right of entry on the property for the removal of trash, mowing of weeds and performance of the necessary duties as a governmental function of the town.
