(A) In addition to any other remedies available in seeking injunctive relief through the courts on any construction done in violation of this chapter, the failure to obtain a permit in accordance herewith shall be a misdemeanor. Any builder or owner who fails to obtain a permit shall be subjected to a fine of ten ($10.00) dollars per day for every day that the work is undertaken without the permit after the initial construction is begun. Each day shall be considered a separate offense.
(B) If upon completion of a building for which a permit has been issued, it appears that the valuation figure stated in the application has been unreasonably underestimated to the extent that it would not be reasonable in regard to the construction prices prevalent in this area, then the under-evaluation shall also be a misdemeanor. Any person violating this provision shall be subject to a fine of not less than two hundred ($200.00) dollars nor more than five hundred ($500.00) dollars.

Division 1. General Provisions
(A) For the purposes of establishing rules and regulations for the construction of buildings and structures as defined in Chapter 198B of the Kentucky Revised Statutes including permits and penalties, there is hereby adopted the current edition of the Kentucky Building Code promulgated in 815 KAR 7:120, and the Kentucky Residential Code promulgated in 815 KAR 7:125, by the Board of Housing, Buildings and Construction, and any and all deletions, or amendments which may hereafter be made thereto. These codes are intended to encompass all buildings as defined in Chapter 198B of the Kentucky Revised Statutes, and are specifically intended to include single-family dwellings. Copies of the current edition of the codes shall be maintained in the offices of the city clerk and the codes inspector. The provisions of the Kentucky Building Code and the Kentucky Residential Code shall govern the construction of all buildings and structures contained within the corporate limits of the city and they are adopted and incorporated as if fully set out at length herein.
(B) The City of Berea hereby establishes a building inspection program for single family dwellings as provided in KRS 198B.060 and the codes adopted above.

It shall be the duty of the codes inspector to enforce the building code of the city, as adopted in § 71.301, and all laws and regulations relating thereto. It shall be the further duty of the codes inspector to ensure that all construction, as defined in KRS Chapter 198B within the city is done in a good and workmanlike manner.

The building official or any employee charged with the enforcement of the building code, acting in good faith and without malice for the city in the discharge of his duties, shall not thereby render himself liable personally. He is hereby relieved from all personal liability for any damage that may accrue to persons or property as a result of any act required or by reason of any act or omission in the discharge of his duties. Any suit brought against the building inspector or employee, because of the act or omission performed by him in the enforcement of any provisions of the code, shall be defended by the corporation of the city until final termination of the proceedings.
