329.04 TREE PROTECTION DURING CONSTRUCTION.
   (a)   The developer shall be required to erect barriers for the protection of remaining trees before development, land clearing, filling or any land alteration. Barriers shall remain until removal is duly authorized by the Director of Public Service or his designee or removal shall occur upon issuance of a final occupancy permit. During construction, no attachments or wires shall be attached to any of the trees protected. Wood, metal or other substantial material shall be utilized in the construction of barriers. Approval of barriers rests with the Director or his designee.
 
   (b)   No person shall conduct any activity within the drip line of any tree designated to be retained, including but not limited to the placing of any solvents, material, construction machinery or soil within the drip line.
