1347.01 CERTIFICATE OF OCCUPANCY REQUIRED.
   On and after July 1, 1966, no owner, agent or person in charge of any dwelling structure used or designed or intended to be used as a multiple dwelling, including institutional residential buildings shall rent, lease or otherwise permit the occupancy of such structure or any part thereof for residential occupancy unless the owner thereof holds a certificate of occupancy issued by the Building Inspector for such structure, which certificate has not expired, been revoked or otherwise become null and void.
   For purposes of this chapter, “institutional residential building” means a building or structure divided into dwelling units that are used as living accommodations by persons having the right or privilege to reside in such structure that is owned or operated by an established organization or foundation, especially one dedicated to education, public service or culture but excluding nursing homes and assisted living centers.
