233.04   ALCOHOL ENFORCEMENT AND EDUCATION FUND.
   (a)   An Alcohol Enforcement and Education Fund is hereby created, in which shall be deposited the monetary amounts as designated in Ohio R.C. 4511.99 as paid by each person convicted of driving while under the influence of alcohol which is to be paid to the Police Department when it is primarily responsible for the arrest of the offender. The fund shall be used by the Police Department for costs it incurs in enforcing the state and local DUI law, and for informing the public of the laws governing the operation of a motor vehicle while under the influence of alcohol, the dangers operation of a motor vehicle while under the influence of alcohol, and other information relating to the operation of a motor vehicle and the consumption of alcoholic beverages.
   (b)   The Director of Finance is authorized and directed to pay into this fund the appropriate amount as designated by Ohio R.C. 4511.99 out of the fine paid to the Village subsequent to the conviction of the offender, retroactive to the effective date of this provision as adopted by the state legislature in 1990.
