3-3-1: DEFINITIONS:
Terms used in this chapter shall have the following meanings:
ALCOHOLIC LIQUORS: All spirits, wine and beer, and every liquid or solid, patented or not, containing alcohol, spirits, wine or beer, and capable of being consumed as a beverage by a human being. The provisions of this chapter shall not apply to alcohol used in the manufacture of denatured alcohol, nor to any liquid or solid containing one- half of one percent (0.5%) of alcohol by volume. Nor shall the provisions of this chapter apply to flavoring extracts, syrups or medicinal, scientific, culinary or toilet preparations or food products unfit for beverage purposes. Nor shall the provisions of this chapter apply to wine intended for use and used by any church or religious organization for sacramental purposes.
CLUB: A corporation organized under the laws of the state, not for pecuniary profit, solely for the promotion of some common object other than the sale and consumption of alcoholic liquors which conforms to the definition of a club in 235 Illinois Compiled Statutes 5/1-3.24.
FULL LINE GROCERY STORE: Any establishment stocking and selling food and foodstuffs at retail, whose retail sales area is not less than five thousand (5,000) square feet, not less than two-thirds (2/3) of which shall be devoted exclusively to the display of food and foodstuffs for sale for consumption off site, and which shall contain at least two (2) of the following: a) a full line bakery department selling varieties of cakes, cookies, pastries, breads, rolls, buns, and other baked goods baked upon and made from doughs produced on the premises; b) a delicatessen department which packages and sells from bulk containers salads, cooked cold meats, cheeses, and other prepared food delicacies; c) a department which butchers or dresses and packages for sale on the premises uncooked meats, poultry, and seafood.
GOVERNMENT SPORTS FACILITY: Any stadium, arena, or other sports facility or complex of associated such facilities located within the boundaries of the village and owned and operated by the village or other governmental entity for the purpose, in whole or part, of exhibiting professional, semiprofessional, or collegiate sports competitions.
HOTEL: Every building or other structure kept, used, maintained, advertised and held out to the public to be a place where food is actually served and consumed and sleeping accommodations are offered for adequate pay to travelers and guests, whether transient, permanent or residential, in which twenty five (25) or more rooms are used for sleeping accommodations of such guests and having one or more public dining rooms where meals are served to such guests, such sleeping accommodations and dining rooms being conducted in the same building or buildings in connection therewith, and such building or structure being provided with adequate and sanitary kitchen and dining room equipment and capacity.
LIVE ENTERTAINMENT: The performance by one or more musicians of live or taped music.
LOCAL LIQUOR COMMISSIONER: The Village President.
MARKET/GROCERY: Any public place kept, used, maintained, advertised and held out to the public as a place where food, groceries, prepared foods and beverages are available for purchase to the public, at which the service of alcoholic beverages is incidental and complementary to the sale of food, groceries, prepared foods and beverages.
OUTDOOR AREA: Any area or structure of the licensed premises or, if authorized by the Local Liquor Control Commissioner, public right-of-way, not wholly within a building or other structure having a solid roof, wall, floor, closable doors, including, but not limited to, areas or structures such as porches, patios, pavilions, summerhouses, courtyards, gangways, and decks, even though they may be partially walled or roofed, fenced, screened with lattice or mesh, or otherwise semienclosed.
RESTAURANT: Any public place kept, used, maintained, advertised and held out to the public as a place where meals are served, and meals are actually and regularly served, at tables, without sleeping accommodations, such space being provided with adequate and sanitary kitchen and dining room equipment and capacity and having employed therein a sufficient number and kind of employees to prepare, cook and serve to its customers or guests, complete meals, including dinner or luncheon menus, at which the service of alcoholic beverages is incidental and complementary to the service of meals. The premises may have a service bar not to exceed six feet (6') in length. In addition, a Class E-1 restaurant may have a bar for patrons where food and liquor are served. The bar for patrons is limited to one foot (1') of bar for every eight (8) restaurant seats. Limited food service establishments, including, without limiting the generality of the foregoing, lounges, restaurant/lounges, luncheonettes, diners, coffee shops, drive-ins or self-service and/or carryout establishments, are not permitted a liquor license.
RETAILER: A person who sells, or offers for sale, alcoholic liquor for use or consumption and not for resale in any form.
VETERANS' ORGANIZATION: Any association or corporation organized not for profit, members of which must have been members of the armed forces or military department of the United States government (a requirement of membership), and which receive their authority for such organization from a national kindred organization.
