§ 56.03 RATES AND CHARGES.
   (A)   User charge provision; surcharges. All sewer users shall participate in the user charge provision as applicable when the concentrations of BOD, TSS or NH3 in the nondomestic wastewater discharged to the city's sanitary shall be imposed upon the permitted industrial user's wastewater flow when the excess is calculated using the industrial plant water flow as specified in § 56.17 and the difference between the actual BOD, TSS or NH3 concentration and the permissible limits of 250 ppm BOD, 240 ppm TSS, or 25 ppm NH3. The surcharge shall reflect the projected cost of creating the excess pounds of nondomcsuc wastewater including necessary costs of adrninistration of the wastewater treatment works, pretreatment and sampling programs and this division.
   (B)   Amount.
      (1)   A surcharge of $60, per 1,000 of BOD, shall be made to cover the fixed charges and amortization costs of additional plant capacity as herein before described.
      (2)   A surcharge of $90, per 1,000 of TSS, shall be made to cover the fixed charges and amortization costs of additional plant capacity as herein before described.
      (3)   A surcharge of $30, per 1,000 of NH3, shall be made to cover the fixed charges and amortization costs of additional plant capacity as herein before described.
      (4)   All sewer users located outside the city limits shall pay a capital recoupment fee equal to 25% of their total surcharges, in addition to those surcharges.
      (5)   All wastewater that exceeds the limits set forth in the nondomestic user's pretreatment permit shall be surcharged for BOD, TSS and NH3 at twice the rates listed in this section. This will be in addition to the above surcharges and any penalties or fines assessed by the city for noncompliance with this chapter.
   (C)   Pretreatment charges and fees. Each industrial user shall pay his proportionate share of the cost of administering the pretreatment and sampling programs and this division. The city may adopt reasonable fees for reimbursement of costs of setting up and operating the city's pretreatment program, which may include:
      (1)   Fees for wastewater discharge permit applications including the cost of processing such applications;
      (2)   Fees for monitoring, inspection, and surveillance procedures including the cost of collection and analyzing a user's discharge, and reviewing monitoring reports and certification statements submitted by users;
      (3)   Fees for reviewing and responding to accidental discharge procedures and construction;
      (4)   Fees for filing appeals;
      (5)   Fees to recover administrative and legal costs (not included in division (C)(2) above) associated with the enforcement activity taken by the control authority to address industrial user noncompliance; and
      (6)   Other fees as the city may deem necessary to carry out the requirements contained herein. These fees relate solely to the matters covered by this chapter and are separate from all other fees, fines, and penalties chargeable by the city.
   (D)   Billings; penalty for late payment.
      (1)   The combined surcharge as set forth herein shall be billed and payable monthly on a separate bill rendered to the proper person by the city's Utility Department. Failure to pay the bill within 15 days shall cause the bill to become delinquent.
      (2)   After five days of delinquency, the city, acting through its duly authorized officers, shall disconnect the water connection serving the premises, and the water connection shall not be turned on again until the bill is paid.
