(a) Unless otherwise provided by a labor agreement, the employees of the City, excluding exempt employees and all elected officials, shall be paid overtime for all hours worked in excess of forty hours per week, or eight hours per day, at the rate of one and one- half times their regular rate. Exempt employees who shall not be paid overtime include the Police Chief, Fire Chief, Public Works Superintendent, Safety-Service Director, Police Prosecutor, Senior Citizens Director, both E-8 Assistants to the Auditor, and all seasonal or part-time employees.

(b) The employees of the Police Department shall be paid overtime for all hours worked in excess of forty hours per week and for all hours worked on declared City holidays at the rate of one and one-half times 1/176th of their monthly salary for each hour worked.
