141.06 APPROVAL OF LOT DIVISIONS.
   (a)   In order to prevent future zoning or building restriction issues or minimum setback problems to arise from the improper division of a real estate lot located within the City limits, no deed providing for the division of any lot within the City limits may be presented for recording in the Washington County Recorder’s Office, or for approval by the Tax Map Office of the Washington County Engineer, or for transfer of ownership in the Washington County Auditor’s Office without the written approval of the Belpre Safety Service Director, acting as the City Engineer and the City Zoning Official, noted upon a plat accompanying said deed.
   (b)   It shall be the responsibility of the party desiring to divide any real estate lot located within the City limits to provide a plat of such division which contains the Safety-Service Director’s written approval of such division with any deed presented for recording.
   (c)   Upon receipt of any proposed deed and plat proposing the division of any real estate lot located within the City limits, the Safety-Service Director, acting as the City Engineer, and the City Zoning Official, shall review the proposed division to determine that the result of such division will not create future zoning or building restrictions, minimum setback problems, or other problems arising from Chapter 11 - Planning and Zoning Code - of the Codified Ordinances. If the Safety-Service Director, acting as the City Engineer and the City Zoning Official, determines that the proposed division will not create future zoning or building restrictions, minimum setback problems, or other problems arising from the City’s Planning and Zoning Code, he/she shall note his/her approval on the proposed plat of the proposed division. However, if the Safety-Service Director, acting as the City Engineer and the City Zoning Official, determines that zoning or building restrictions, minimum setback problems or other problems arising from the City’s Planning and Zoning Code, would arise from the proposed division, he/she shall either reject said division or shall note upon the plat that the proposed division is approved with specific restrictions as to future use of the divided lot or lots.
   (d)   The Washington County Recorder, Tax Map Office of the Washington County Engineer, and the Washington County Auditor are requested and directed to reject any deed which provides for the divisions of any real estate lot located within the City limits which is not accompanied by a plat of such division which contains the written approval of such division by the Safety-Service Director, acting as the City Engineer and the City Zoning Official.
