1105.07 WATER AND SEWER DEVELOPMENTS.
   The City Engineer shall also be the Sanitary Engineer and is responsible for the design, inspection and enforcement of all public sewer, public water, group sewer, or group water developments as outlined in the following regulations.
   (a)    Public Water and Sewage Disposal Systems.
      (1)    In the event a public water supply and a public sewage disposal system can reasonably be made available by the extension and construction of water and sanitary sewers, the developer shall be required to provide such utilities and, if deemed advisable by the City Engineer, may require their construction to be complete prior to the sale of one or more lots or parcels in the subdivision.
      (2)    The design of such utilities, together with the preparation of drawings and specifications and the construction thereof, shall be done by or under the supervision and direction of the City Engineer and in accordance with the current rules, regulations, specifications and procedures of the City Engineer.
      (3)    When it is necessary to obtain the permission and approval of a political subdivision to extend or use any existing utility or to occupy any street or right of way, the obtaining of such permission and approval shall be the responsibility of the developer.
   (b)    Costs of Improvements. The entire cost of preparing drawings and specifications, including engineering, supervision and overhead together with inspection of construction shall be borne by the developer. If required by the City Engineer, the estimated cost to the City of such work shall be deposited with the City Engineer prior to approval of the subdivision plat.
   (c)    Assurance of Completion of Improvements. The developer shall submit to the City Engineer satisfactory proof that the conditions herein stipulated shall be conformed to. If required by Council, a performance bond for the estimated amount of the construction cost shall be deposited with an authorized officer of the City, conditioned on the faithful performance of the requirements herein stated or referred to herein.
   (d)    Conflict. Nothing herein shall be construed to alter or supercede the requirements stipulated in Ohio R.C. 6103.01 et seq. and 6117.01 et seq. or the rules and regulations established by Council and the City Engineer.
