909.01 PERMIT REQUIRED.
   (a)   No person shall break the surface or pavement of any City street, curb alley, or culvert without first obtaining a permit from the Safety-Service Director.
   (b)   A written application for such a permit shall be made to the Safety-Service Director, with a description of the location ad work proposed by the applicant.
   (c)   Such application shall be accompanied by a description of the construction methods and procedures which will be utilized, as well as an estimate of the cost to complete the construction.
   (d)   Such application shall further be accompanied by a performance bond in form and with conditions acceptable to the Director to adequately insure the repair of such street or alley. The bond shall be waived as to City Departments.
   (e)   In the event of a legitimate emergency situation, a utility company or department of the City may break the surface or pavement of a City street or alley without first obtaining a permit, provided that prior verbal consent is given by the Safety-Service Director or his authorized representative in the event of his absence and further provided that the person breaking the pavement or surface shall within three business days submit the application and bond for the permit heretofore described.
