(a) Operation of Motor Vehicles. It shall be unlawful to do any of the following within the City of Belpre, Ohio:
(1) To sound any signaling device from a motor vehicle, except to give warning to other drivers or pedestrians.
(2) To screech the tires of a motor vehicle or to create noise from a motor vehicle in any manner by unnecessary acceleration, deceleration, braking or turning thereof.
(3) To operate a motor vehicle that has been so altered or is so out of repair as to in any manner create loud and unnecessary noise that would disturb the peace and quiet of the residents of the City. All motor vehicles shall be equipped with the same as, or quieter than, original factory equipment.
(b) Playing of Radios and Other Sound Devices Restricted. It shall be unlawful to do any of the following within the City of Belpre, Ohio:
(1) To play any radio, music player such as a “boom box”, tape cassette, disc player or television, audio system or musical instrument or any other type of sound device upon any public road, street, highway or private property in a manner or at a volume as to disturb the quiet, comfort, or repose of other persons, or at a volume which is plainly audible at a distance of fifty feet. An exception is made for organized events which have received a valid permit from the City.
(c) Penalty.
(1) Whoever violates any provision of this section shall be subject to the following penalty:
First Offense: | Minor misdemeanor. |
Second and Subsequent Offenses: | Fourth degree misdemeanor. |
(2) Upon conviction for a second or subsequent violation of subsection (b) hereof, the sound device used during the commission of the offense shall be subject to confiscation.
