ORDINANCE NO. 11-3
AN ORDINANCE ENACTING AND ADOPTING A SUPPLEMENT TO THE CODE OF ORDINANCES OF THE VILLAGE OF BELLWOOD AND DECLARING AN EMERGENCY
WHEREAS, the Village of Bellwood (hereinafter referred to as the "Village") is an Illinois Municipal Corporation organized pursuant to the laws of the State of Illinois;
WHEREAS, the Village is a home rule municipality as defined by Article VII of the Illinois Constitution;
WHEREAS, American Legal Publishing Corporation of Cincinnati, Ohio, has completed the supplement and update to the Code of Ordinances of the Political Subdivision (a copy of which is attached hereto and made a part hereof as Exhibit A), which supplement contains all ordinances of a general and permanent nature enacted since the prior supplement to the Code of Ordinances of this Political Subdivision;
WHEREAS, American Legal Publishing Corporation has recommended the revision or addition of certain sections of the Code of Ordinances which are based on or make reference to sections of the Illinois code;
WHEREAS, it is the intent of the Legislative Authority to accept these updated sections in accordance with the changes of the laws of the State of Illinois;
WHEREAS, it is necessary to provide for the usual daily operation of the municipality and for the immediate preservation of the public peace, health, safety and general welfare of the municipality that this ordinance take effect at an early date;
WHEREAS, the Corporate Authorities of the Village of Bellwood have determined that it is in the best interests of the public health and safety of the residents of the Village of Bellwood to adopt the supplement and revisions therein of the Village of Bellwood.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Bellwood, Cook County, Illinois, in open meeting assembled, pursuant to the Village of Bellwood's "Home Rule Powers" that the Village of Bellwood Municipal Code be amended and restated as follows:
Section One - Recitals
   The Corporate Authorities hereby find that all of the recitals hereinbefore stated as contained in the preamble to this Ordinance are full, true and correct and do hereby, by reference, incorporate and make them part of this Ordinance as legislative findings.
Section Two - Adoption of Village of Bellwood Municipal Code
   (1)   That the supplement to the Code of Ordinances of the Political Subdivision as submitted by American Legal Publishing Corporation of Cincinnati, Ohio, and as attached hereto and made a part hereof as Exhibit A, be and the same is hereby adopted by reference as if set out in its entirety.
   (2)   Such supplement shall be deemed published as of the day of its adoption and approval by the Legislative Authority and the Clerk of the Political Subdivision is hereby authorized and ordered to insert such supplement into the copy of the Code of Ordinances kept on file in the Office of the Clerk.
   (3)   This ordinance is declared to be an emergency measure necessary for the immediate preservation of the peace, health, safety and general welfare of the people of this municipality, and shall take effect at the earliest date provided by law.
Section Three - Conflict Clause
   That all ordinances or part of ordinances in conflict with the terms of this Ordinance shall be repealed to the extent of said conflict.
Section Four - Passage Clause
   That this Ordinance shall take full force and effect from and after its passage, approval and publication as provided by law.
Section Five - Constitutionality Clause
   Any part or parts of this Ordinance declared by a court of law to be invalid or unconstitutional shall not affect the validity of the remaining provisions of the Bellwood Municipal Code.
Section Six - Recording
   This Ordinance shall be entered into the minutes and upon the journals of the Board of Trustees of the Village of Bellwood.
