§ 117.041 PERMIT PROVISIONS.
   (A)   Permit required. Every person desiring to operate a day nursery in the village shall obtain a permit therefor before commencing operation.
   (B)   Application. Every person desiring a permit to operate a day nursery shall make application therefor to the Village Clerk on forms furnished by him or her. The application shall contain such information as may be required by the Village Clerk.
   (C)   Investigations. Upon receipt of an application for a permit required by division (A) of this section, the Village Clerk shall refer it to the Health Officer for investigation. The Health Officer shall inspect the premises wherein the day nursery is proposed as to the following conditions:
      (1)   The operation and conduct of the facility and the responsibility it assumes for child care.
      (2)   The character, suitability and qualifications of the applicant and other persons directly responsible for the care and welfare of children served.
      (3)   The general financial ability and competence of the applicant to provide necessary care for children and to maintain prescribed standards.
      (4)   The adequacy of the number of individuals required to insure adequate supervision and care of the children.
      (5)   The appropriateness, safety, cleanliness and general adequacy of the premises, including maintenance of adequate fire prevention and health standards in conformance to state laws.
      (6)   Provisions for food, clothing, educational opportunities, programs, equipment and individual supplies to assure the healthy physical, mental and spiritual development of the children served.
      (7)   Discipline of the children.
   (D)   Issuance; appeal to Board.
      (1)   If, after investigation, the Health Officer recommends the issuance of the permit, the Village Clerk shall issue such permit, which shall be valid for the village license year.
      (2)   Any person aggrieved by the failure of the Health Officer to approve the issuance of a day nursery permit may appeal to the Board of Trustees, whose decision shall be final.
   (E)   Revocation. Any permit issued under the terms of this subchapter may be revoked for the following reasons:
      (1)   Consistent failure to maintain health standards prescribed.
      (2)   Violation of the terms of the permit.
      (3)   Furnishing or making false or misleading information in the application.
