Any person accused of violating any provision of this Chapter 72 shall be subject to the fine established in Chapter 38 of this code; provided, however, that any person accused of violating § 72.13 of this code shall be subject to the fines established in Chapter 38 of this code, which fines may be paid at the Village Police Station, and for which paid fines a receipt shall be issued. All fines collected under this § 72.99 shall be forwarded to the Village Treasurer for deposit in the village's general fund. The Police Department may, at the Police Chief's discretion, refrain from seeking the prosecution of any person, entity, or corporation cited for an offense of this Chapter 72. Notwithstanding anything to the contrary in this § 72.99, any person charged with parking or otherwise leaving a vehicle so as to (a) obstruct the entrance or exit of any place where Police or Fire Department apparatus or other emergency equipment is kept; (b) obstruct an emergency entrance to a hospital; (c) obstruct vehicular traffic in any street, alley, or other public right-of-way; or (d) any person who refuses, for any reason, to move, or cause to be moved, an illegally parked vehicle at the request of any member of the Police Department shall be subject to the fines and penalties established in Chapter 38 of this code.
