§ 51.002 CONSTRUCTION OF NEW WATER WELLS PROHIBITED.
   (A)   (1)   No person shall dig, drill, construct, or install a water well for any purpose whatsoever on any lot or parcel when a village water line is available within 100 feet of a lot or parcel boundary and where the water line is capable of providing sufficient water service for the lot’s or parcel’s intended use.
      (2)   The Water Superintendent shall determine whether adequate water service can be consistently provided to the lot or parcel.
   (B)   No person whose lot or parcel boundary is greater than 100 feet from a village water line or, if nearer, sufficient water service cannot be obtained shall drill, dig, construct, or install a water well without first making application for and obtaining a water well construction permit as required by the State Department of Health or County Health Department and obtaining a permit from the Water Superintendent.
   (C)   Whoever violates division (A) or (B) above shall be guilty of a misdemeanor of the fourth degree.
