§ 28-28 CONFORMITY AND SPECIFICATIONS OF THE PUBLIC WORKS DEPARTMENT FOR SIDEWALK IMPROVEMENT.
   (A)   The public works director shall periodically review and determine plans and specifications to be applicable to all sidewalks within the city which are designated, altered, constructed or substantially repaired after the effective date of this section; provided however that such plans and specifications shall not be effective unless first approved by the city council.
   (B)   It shall be unlawful to construct or substantially repair any sidewalk in the city until a permit authorizing such work has been issued by the Permits and Inspections Department of the city.
   (C)   Application for a permit shall be made in writing to the Permits and Inspections Department on such forms as shall be considered appropriate. Application shall be accompanied by a fee established for such purpose by the city council.
   (D)   All work and improvements made pursuant to such permit shall be inspected by the public works director or the director’s designated representative upon completion and shall meet and be in conformity with the plans and specifications of section 28-28 or the resolution of the city council adopted pursuant to section 28-29 unless a waiver has been granted by the city council pursuant to sections 28-33 and 28-34 of this article; provided, however, no such waiver shall be available whenever such work has been ordered by the city council pursuant to section 28-29 of this article. Whenever the city council grants any waiver authorized by this article, a permit to construct or repair a sidewalk shall be issued in conformity with the decision of the city council. Such work and improvements shall be constructed at and upon the location and according to city sidewalk specifications developed and approved in accordance with this section. An on-site inspection and survey of the site for which a permit has been issued for sidewalk repair or construction shall be done by the public works director or the director’s designated representative at least 24 hours prior to the commencement of the pouring of concrete, or the commencement of any other work entailing substantial permanent improvement to a sidewalk, in order to determine that the sidewalk is constructed or repaired according to the location, grade and elevation required by the plans and specifications for sidewalk improvement applicable in accordance with this section.
