8-1-8: WATER CONSERVATION MEASURES:
   A.   Wasting Water Prohibited: It shall be unlawful for any person to waste any water from the Municipal water system, including, without limitation, by excessive irrigation or leaking water service line or water pipes.
   B.   Irrigation Restrictions:
      1.   During any one calendar year, no person shall irrigate a total of more than ten thousand (10,000) square feet of a single parcel or lot of real property with water from the Municipal water system. (Ord. 2010-06, 9-23-2010)
      2.   a. Between May 1 and September 30 of each calendar year, it shall be unlawful for any person to irrigate any property within the City with water supplied by the Municipal water system except in compliance with the schedule and regulations set forth in this subsection B2.
         b.   The sprinkling or watering of outdoor plantings such as grass, lawns, gardens, ground cover, shrubbery, trees or other landscaping shall be restricted upon all properties with even numbered street addresses to even numbered calendar days and upon all properties with odd numbered street addresses to odd numbered calendar days, and shall be prohibited between the hours of ten o'clock (10:00) A.M. to eight o'clock (8:00) P.M. daily except as follows:
            (1)   Upon written request made by a water user, the City's authorized agent may grant an exception to the prohibition and restriction of Municipal water usage if the water user's usage will be for the purpose of sprinkling or watering new plantings for a specified time period. The exception will only apply to the newly planted area.
            (2)   Sprinkling or watering by commercial nurseries on their own sites is specifically excluded from the prohibitions and restrictions of this subsection B2.
            (3)   The water user is using water conservation irrigation devices such as drip or bubbler style irrigation system that minimize water evaporation losses. (Ord. 2016-01, 7-11-2016)
   C.   Emergency Water Rationing:
      1.   The Common Council is hereby empowered to adopt by resolution emergency regulations and restrictions on the use of water during times of drought, low precipitation or inadequate water supply. Such emergency regulations and restrictions may include, but are not limited to, restricting the time of day of water use, the days of water use, the types of water use and the duration of water use for irrigation and/or domestic purposes. Such resolution shall become effective upon posting in at least five (5) public places within the City or upon publication in the official newspaper of the City.
      2.   In addition to the powers set forth in subsection C1 of this section, the Mayor is hereby empowered to adopt by emergency proclamation temporary restrictions and/or temporary suspension of water use and water service for irrigation and other nonessential domestic purposes if he finds that, because of drought, low precipitation, inadequate water supply, lack of fire flow, damage to the water system or any portion thereof, or contamination to the public water supply, that such temporary restrictions and/or temporary suspension of services are reasonably necessary to protect the public health and safety. Such emergency proclamation may include restricting the duration of water use or temporarily suspending water service for irrigation and/or other nonessential domestic purposes, and may authorize City personnel to enter upon private lands, but not private buildings, to shut off irrigation and other nonessential domestic uses of water from the Municipal water system. Such emergency proclamation shall be in writing, state the reason for the declaration, the precise restrictions and/or temporary suspension of water service proclaimed. Such an emergency proclamation shall continue until the Mayor finds the emergency has passed and terminates such emergency proclamation in writing, however, no such emergency proclamation may extend for a period in excess of thirty (30) days.
      3.   Any person violating the emergency regulations or restrictions set forth in such resolution shall be guilty of violating this chapter and shall be subject to the penalties set forth in section 8-1-14 of this chapter.
      4.   Prior to the enactment of any emergency water rationing by the Common Council or declaration of an emergency proclamation by the Mayor, the City shall first suspend irrigation of all City parks and other City grounds and cease use of water by all City departments and personnel for nonessential domestic purposes, such as washing of cars and equipment.
