§ 90.029 VICIOUS DOGS.
   (A)   Any dog of a sufficient size as necessary to inflict serious injury that has been guilty of an unprovoked attack on any individual or domestic animal when said individual or animal was on its own property or upon public property, in the event of a second such unprovoked attack that is proven in court beyond a reasonable doubt, shall be declared a VICIOUS DOG.
   (B)   In the event of such a finding by any court of competent jurisdiction, the animal in question shall be subject to destruction, and any owner of said animal or any individual found to be harboring said animal shall be subject to the maximum fine and penalty provided for herein.
