§ 90.025 POTENTIALLY DANGEROUS DOGS.
   (A)   (1)   A dog is hereby declared to be POTENTIALLY DANGEROUS under the animal regulations of the city when the animal has, without cause or provocation, chased, threatened or otherwise interfered with the normal activities of human beings or domesticated animals when said humans or other animals were in the process of normal activities on their own property or in public areas.
      (2)   In order for an animal to be declared POTENTIALLY DANGEROUS, the animal needs to be of a size that a normal person would believe could subject said individual, or animal under the control of said individual, substantial bodily harm.
   (B)   (1)   At any time such behavior by a dog has been witnessed and determined by an officer of the Police Department, or by the Animal Control Officer, then the owner of such animal may be cited for having a potentially dangerous dog at-large and not under physical control within the city.
      (2)   If such offense is determined by the Municipal Court, then the owner or person harboring said dog shall be subject to fine, penalty and such other conditions as provided herein, and the dog may be ordered confined as provided for herein.
