§ 90.009 NOISY ANIMALS; NUISANCE; VICIOUS ANIMALS.
   (A)   No person shall keep any animal which causes frequent or long-continued noise, or otherwise, so as to disturb the comfort or repose of any person in the vicinity. Any violation of this section is declared to be a nuisance and, as such, may be abated.
   (B)   No person shall keep any animal which is a nuisance or is vicious as defined in this chapter.
   (C)   (1)   Keeping any animal in violation of this chapter is also hereby declared to be a nuisance.
      (2)   The city may summarily abate any such nuisance after notice to the owner of the premises where the kennel is located and an opportunity for such person to be heard, if such can be given.
      (3)   The city may, in the alternative and in the discretion of the City Council, pursue the abatement thereof by suit in District Court or enforce as a misdemeanor.
