(A) Any person that violates any section of this chapter is subject to the penalty provisions set forth in Chapter 10 of the Code of Ordinances for the Town of Beech Mountain. Each separate occurrence is deemed a separate offense.
(B) Pursuant to G.S. § 14-4, any person violating any section of this chapter shall, upon conviction, be guilty of a Class 3 misdemeanor and shall be punished by a fine not to exceed $50 or imprisoned for a period of not more than 30 days, unless the discharge of a weapon results in a person, animal, vehicle or structure being struck by a projectile where damage or injury is apparent, they shall then be punished by a fine not to exceed $500 or imprisoned for a period of not more than 30 days.
