§ 51.120 PRIVIES, CESSPOOLS, AND THE LIKE PROHIBITED; EXCEPTION.
   (A)   Except as otherwise provided by the Board of Public Works and Safety, the city, or the state, or any of its agencies, a person shall not construct or maintain a privy, septic tank, cesspool, or other facility intended or used for the disposal of wastewater.
   (B)   It shall be unlawful to construct, maintain, or use any septic tank cesspool, or any other facility intended or used for disposal of sewage or wastewater within the limits of the city, except as set forth below.
      (1)   Where the facility serves a dwelling, building, or area outside the limit of 400 feet from the community sewer.
      (2)   Where a permit is granted.
