§ 33.62 CLASSIFICATION OF VIOLATIONS.
   The three classes of violations are as set forth below.
   (A)   Class l.
      (1)   The following actions will be taken for Class 1 violations.
         (a)   First violation, verbal instruction.
         (b)   Second violation, written instruction.
         (c)   Third violation, one week suspension without pay.
         (d)   Fourth violation, discharge.
      (2)   The following are considered Class 1 violations.
         (a)   Absenteeism.
         (b)   Violation of safety rules.
         (c)   Off-duty conduct.
         (d)   Leaving early.
         (e)   Extension of lunch time or break time.
         (f)   Tardiness.
         (g)   Moonlighting.
         (h)   Insubordination.
   (B)   Class 2.
      (1)   The following actions will be taken for Class 2 violations.
         (a)   First violation, written instruction or one week suspension without pay.
         (b)   Second violation, one week suspension without pay.
         (c)   Third violation, discharge.
      (2)   The following are considered Class 2 violations.
         (a)   Disorderly conduct.
         (b)   Absenteeism or being absent for three or more consecutive days without notification.
         (c)   Unauthorized use of government vehicles.
         (d)   Interference with city operations.
         (e)   Failure to report change in address or marital status.
   (C)   Class 3.
      (1)   The following actions will be taken for Class 3 violations.
         (a)   First violation, one week suspension without pay or discharge.
         (b)   Second violation, discharge.
      (2)   The following are considered Class 3 violations.
         (a)   Conflict of interest.
         (b)   Accepting gifts or gratuities.
         (c)   Use of city property, equipment, or vehicles for personal gain.
         (d)   Falsification of public records.
         (e)   Criminal activity.
         (f)   Release of confidential information.
         (g)   Intentional damage or destruction of city property.
         (h)   Engaging in the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance in the workplace.
         (i)   Failure of an employee to report a criminal drug statute conviction as required in § 33.12(W).
