§ 33.12 CODE OF CONDUCT.
   (A)   Conflict of interest. No city employee shall have a direct or indirect interest in any procurement or contract made by the city. Further, no city employee, nor a member of the employee’s family, shall use knowledge obtained as a result of his affiliation with the city to derive a financial benefit. Any conflict, or potential conflict, shall be reported to the office of the Personnel Director.
   (B)   Gifts and gratuities. No city employee shall accept or solicit gifts or gratuities from any individual, company, or corporation that conducts business or is attempting to conduct business with the city.
   (C)   Use of city property, equipment, or vehicles for personal gain. No city employee shall use city property, equipment, or vehicles for personal gain. Nor shall any city employee accept tips or compensation other than regular city compensation for services provided using city property, equipment, or vehicles.
   (D)   Disorderly conduct. No employee shall participate in horseplay, gambling, card games or other games, sleeping, or personal business during working hours. Nor shall any employee use obscene language, drink, or have possession of intoxicating beverages or drugs or engage in fighting during working hours.
   (E)   Falsification of public records. No city employee shall falsify any city records or time cards.
   (F)   Criminal activity. No city employee shall participate in criminal activity, or knowingly violate any state, federal, or local law.
   (G)   Off-duty conduct. The city does not intend to direct the off-duty activities of city employees; however, no city employee shall be permitted to participate in an off-duty activity which unduly affects the mission of the city, the efficiency of the city’s operations, or the city’s responsibility in behalf of the general public.
   (H)   Absenteeism. City employees have the responsibility to report absences to their department heads or supervisor within 30 minutes of the beginning of the shift to which the employee is assigned.
   (I)   Tardiness. It is the responsibility of the employee to report to work on time. Failure to report within five minutes of the beginning of the shift will result in the docking of pay.
   (J)   Safety rules. It is the responsibility of the employee to follow the safety rules established by the city and OSHA.
   (K)   Notification of change in address or marital status. It is the responsibility of the employee to report any change in address or marital status immediately to the Personnel Officer.
   (L)   Confidential information. No city employee shall divulge confidential or classified information to any unauthorized person.
   (M)   Government vehicle. No city employee shall use city vehicles for unauthorized purposes.
   (N)   Leaving early. No city employee shall leave work early without proper authorization from his supervisor or department head.
   (O)   Insubordination. No city employee shall be insubordinate to their supervisor, department, or the city administration. Disagreement with city policy shall be handled through the normal grievance procedure.
   (P)   Moonlighting. No city employee shall hold outside employment without authorization from the Mayor.
   (Q)   Abuse of break times. No city employee shall abuse his lunch time or break time without authorization from his supervisor.
   (R)   Interference with city operations. No city employee shall interfere with city services, or refuse to perform a necessary service connected with the efficient operation of the city, or refuse to obey any reasonable order by a supervisor connected with the provision of city services.
   (S)   Damage or destruction of city property. No city employee shall intentionally damage or destroy city property.
   (T)   Report of accidents. All accidents, including those involving personal injury, equipment, or vehicles, shall be reported immediately to the employee’s supervisor.
   (U)   Participation in other activities. No city employee shall participate in any activity which jeopardizes the efficient provision of services in behalf of the public by the city.
   (V)   Keeping a drug-free workplace. No city employee shall engage in the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance in the workplace.
   (W)   Reporting a criminal drug statute conviction. It is the responsibility of the employee to report to the city any conviction of such employee of a criminal drug statute violation within five days of such conviction. The report shall be made to the Clerk-Treasurer. The Clerk-Treasurer shall notify in writing the contracting state agency and the Indiana Department of Administration within ten days after receiving notice from an employee of such conviction, or otherwise receiving actual notice of such conviction.
