1177.04 APPROVAL BY PLANNING COMMISSION.
   (a)    The Planning Commission may authorize the issuance of a permit if the child care center meets the requirements imposed by this section and Chapter 1177. In making this determination, the Planning Commission, in addition to addressing the requirements set out in Chapter 1177, shall consider the following factors:
      (1)    Impact on the community permitting a child care center to be located in that particular location.
      (2)   Location and number of other child care centers in the city.
      (3)   The need to maintain neighborhood characteristics.
      (4)    Needs of residents of the community.
      (5)   Needs of the children to be cared for in the child care center center.
   (b)    If the Planning Commission determines that a permit for a child care center should be issued, it shall so instruct the Building Commissioner to issue the permit.
   (c)   The Planning Commission shall have the right to waive any provision of the standards and guidelines as set forth in this Chapter, provided that such waiver will not have a negative impact on the community or be injurious to the public health, safety or general welfare of the community and the children attending such a child care center or nursery school and the property owners in the vicinity of such child care center or nursery school.
   (d)    Renewal of the Permit. The permit shall be renewed on or before August 1 of every other year. The renewal application along with the two hundred dollars ($200.00) renewal fee shall be filed with the Building Commissioner by July 1 of the year of renewal, and shall include all items required for an original application under Section 1177.03(b)(1)-(12). If the application is for a renewal of a permit, the Planning Commission shall review such renewal request, and if after conducting its review and finding continuing compliance with this chapter, any waivers therefor and the terms of this permit, the permit shall be renewed.
   (e)    The child care center shall furnish the Planning Commission with copies of the results of all state and county inspections.
   
   (f)    The Planning Commission shall have the authority to review a permit at any time within the permit period and to modify or revoke the same for just cause after a hearing at a time and place fixed by the Commissioner.
