920.05 LIMITATIONS ON WASTEWATER STRENGTH.
   (a)   Federal Requirements. National categorical pretreatment standards as promulgated by the U.S. Environmental Protection Agency (US EPA) pursuant to the Act shall be met by all industrial users which are subject to such standards.
 
   (b)   State Requirements. State requirements and limitations on discharges to the POTW shall be met by all dischargers which are subject to those standards in any instance in which they are more stringent than Federal requirements and limitations or those in this or any other applicable ordinance.

   (c)   Local Requirements. No discharger shall discharge or cause to be discharged into the sewerage system any pollutants in concentrations above those in the potable water supplied to the premises, unless specifically permitted in a wastewater discharge permit issued by the City. Local limits are incorporated into the Industrial Use Permits based on the latest technical justification by the OEPA. Best Management Practices (BMPs) must be used and clearly stated in all compliance reports. The City shall develop, update as necessary, and enforce local limits that will protect Bedford Heights WWTP against interference and pass through. The city may develop BMPs and such BMPs shall be considered local limits and pretreatment standards for the purpose of this chapter.

      (1)   Mass limitations on discharges are intended to prevent the use of dilution to meet the pretreatment standards or requirements of this chapter, or in other cases where the imposition of mass limitations is deemed appropriate by the City.
      (2)   No statement contained in this chapter shall be construed as prohibiting any special agreement or arrangement between the City and any person whereby an industrial waste of unusual strength or character may be admitted to the sewage disposal works, either before or after pretreatment, provided there is no impairment of the functioning of the sewage disposal works by reason of the admission of such wastes and no extra costs are incurred by the City without recompense by such person. No such special agreement may allow violation of State and/or Federal rules and regulations including categorical standards.

   (d)   Dilution. No discharger shall increase the use of potable or process water in any way for the purpose of diluting a discharge as a partial or complete substitute for adequate treatment to achieve compliance with the standards set forth in this chapter. This shall not prohibit the use of equalization tanks utilized to regulate flows.

   (e)   “Best Management Practices” or “BMPs” means schedules of activities, prohibitions of practices, maintenance procedures and other management practices to implement the prohibitions listed in Section 920.04. BMPs also include treatment requirements, operating procedures, and practices to control plant site runoff, spillage or leaks, sludge or waste disposal, or drainage from raw materials storage.
