§ 111.10 EVENT LICENSING.
   (A)   Event exception. The provisions of §§ 111.02 through 111.07 apply to an event.
   (B)   Sponsor permit. No person shall be a sponsor of an event within the borough without first obtaining, from an authorized representative of the borough, an event permit.
   (C)   Permit application.
      (1)   A sponsor requesting an event permit shall make application therefor, in writing, to the Borough Office. Such application shall be accompanied by such fees, as required by the schedule of fees, established by and amended from time to time by resolution of Borough Council. Such application shall set forth and include the following information:
         (a)   The name, business name, and address of the sponsor and the property owner, if different than the sponsor, and of each person to be licensed to engage in transient retail business at the event;
         (b)   Contact information, including the phone number and e-mail address of the sponsor and the property owner, if different than the applicant, and of each person to be licensed to engage in transient retail business at the event;
         (c)   Types of goods to be sold and proposed hours of operation;
         (d)   Written consent of the property owner, if different than the applicant; and
         (e)   Such other information as may be required from time to time by the borough.
      (2)   No action shall be taken on any application for an event permit under this section until the application has been completed in its entirety and the fees, as required by a schedule of fees, established and amended from time to time by resolution of the Borough Council, have been paid in full.
   (D)   Specific standards. The following regulations shall apply to all events.
      (1)   Events shall only be conducted on private property situate in zoning districts that permit retail sales of goods.
      (2)   Events shall only be permitted from dusk to dawn. The specific hours shall be designated on the permit as determined by the borough based on the time of year.
      (3)   The sponsor shall provide access to restroom facilities situate on the same property as the event which shall be open to customers at all times that goods are being sold.
      (4)   The sponsor shall provide adequate trash or garbage receptacles on the same property as the event.
      (5)   The sponsor and all persons conducting transient retail business shall comply with all federal and state laws and regulations and all borough ordinances, including, but not limited to, sign, noise, and health and safety ordinances.
      (6)   The permit shall be publicly displayed at the event site at all times.
   (E)   Permit duration. Event permits shall be issued on a daily basis. No event permits shall be issued for the weekends of the Fall Foliage Festival without the approval of Borough Council.
   (F)   Event license. No person shall engage in any transient retail business within the borough during an event without first having been included on an event permit obtained by an event sponsor.
   (G)   Denial, suspension, appeal, and penalties. The provisions of §§ 111.08 and 111.99 shall apply to event permits and event licenses.
