Burning in a safe and unoffensive manner shall be allowed between the hours of 6:00 a.m. and 6:00 p.m. provided:
(A) There shall be no burning on the streets, curbs, gutters, or sidewalks;
(B) If in a container, a fire must be at least 15 feet from a structure; if on an open pile, a fire must be at least 50 feet from a structure;
(C) No garbage, inorganic material, including plastics or animal feces, are to be burned;
(D) The Fire Prevention Officer may ban burning when deemed necessary and order any unsafe fire extinguished; and
(E) Open burning of trees, logs, brush, stumps, leaves, and grass clippings is allowed only in accordance with the following provisions:
(1) Except as provided in division (E)(4) below, open burning of trees, tree limbs, logs, brush, stumps, leaves, or grass or shrubbery clippings shall only be conducted on the first and third Wednesday and the second and fourth Saturday of each month. On those designated days, open burning of the specified items shall be permitted from 8 a.m. to 6 p.m., subject to the other terms of this subchapter;
(2) All allowed open burning shall be conducted in a safe manner, when wind and weather conditions minimize adverse effects and do not create a visibility hazard on roadways. Open burning shall be conducted in conformance with state and local fire protection regulations;
(3) Except for fires permitted under (E)(4) below, open burning shall be conducted only on the property on which the materials being burned were generated;
(4) Outdoor campfires and small bonfires for cooking, ceremonies, or recreation are allowed, provided they do not cause a public nuisance; and
(5) Open burning shall be constantly attended and supervised by a competent person of at least 18 years of age until the fire is extinguished and is cold. The person shall have readily available for such use fire extinguishing equipment as may be necessary for the total control of the fire.
