13.04.260: RESALE OF VILLAGE WATER:
   A.   Resale Prohibited: It is unlawful for the owner, lessee or occupant in control of premises served by the Village water supply, to resell Village water to any consumer or user of Village water.
   B.   Validity Of Agreements In Violation: Any provisions of any lease, agreement, contract or other understanding or evidence of agreement in violation of this section shall be invalid and unenforceable. Nothing in this section shall be construed to invalidate any provision of any lease, agreement, contract or other understanding or evidence of agreement that does not violate this section.
   C.   Violation; Penalty: Any person who is found to violate any provision of this section shall be fined pursuant to the general penalty provisions of this Code for each offense, and a separate offense shall be deemed committed for each bill, statement or invoice rendered for water consumption charges, or for each request or demand for money or any other compensation made by any person or company in violation of this section.
   D.   Exception:
      1.   The prohibition against resale of Village water as provided in this section shall not apply to reselling water, if and only if:
         a.   An owner or operator of a multi-family dwelling complex applies for and receives a permit from the Village to install individual water meters for each dwelling unit owned or operated;
         b.   The meters are Village authorized meters, and meter installations conform to the standards for water meter installation as specified by the Village for Village residential services, see subsection 13.04.170C of this chapter; and
         c.   The permit application contains the following information and such other information as may be reasonably requested by the Superintendent of Water:
            (1)   Names, addresses and phone numbers of the applicant, the owner and the operator of the subject premises.
            (2)   The number of meter installations.
            (3)   The manufacturer's installation instructions and warranty of the subject meter.
            (4)   The Illinois plumber's license number, and apprentice plumber's license number; name, address and phone number of the licensed plumber making or lawfully supervising the installation of the meters; and a copy of the plumber's and apprentice plumber's license.
            (5)   The total cost of the installations.
            (6)   Each location by address or apartment number where the installation will take place.
            (7)   The owner or operator's description of his/her/its program for the:
               (A)   Periodic testing of all meters, when required, to the standards and testing frequency, as required by the village.
               (B)   Handling of complaints regarding meters alleged to be running fast or slow or leaking installations.
               (C)   The method of billing and frequency thereof.
               (D)   A copy of any written agreements pertaining to the usage or billing of water.
      2.   All permits issued under this section shall be conditional and the conditions shall be:
         a.   That the owner and operator implement and maintain the approved meter inspections and testing plans submitted with the application or any subsequently approved amended plans thereof.
         b.   That statements in the permit application are and remain true and accurate.
         c.   The owner or operator's billings to the consumers shall not exceed the cost of the water to the owner or operator. "Cost of water" shall mean the rate which is charged by the village to the owner or operator.
         d.   The owner or operator shall not charge for sewer service any sum in excess of the direct actual charges of user per unit of measurement charged by the North Shore sanitary district and the village. (Ord. 2015-O-4: Ord. 2000-O-18 § 1)
